First Conviction – Class B Misdemeanor

  • $2,000 fine
  • 72 hours – 6 months in jail
  • Suspended driver's license for up to a year if you do not attend a DWI Education class within 180 days of receiving the violation
  • $1,000 every year for three years to keep your driver's license
  • 24-100 hours of community service
  • Mandatory attendance to a Victim Impact Panel

Total Fees:  $5,000*


 

Second Conviction – Class A Misdemeanor

  • $4,000 fine
  • 72 hours – 1 year in jail
  • Suspended driver's license for 180 days – 2 years
  • $1,500 every year for three years to keep your driver's license
  • 80-200 hours of community service
  • TYPICALLY the court will order a deep lung air device to be installed in the person’s car that gives the person a breathalizer test before the car will start. 

Total Fees:  $8,500*


 

Third Conviction – 3rd Degree Felony

  • $10,000 fine
  • 2-10 years in prison
  • Suspended driver's license for 180 days – 2 years
  • $2,000 every year for three years to keep your driver's license
  • 160-600 hours of community service

 

Total Fees:  $16,000*


 

Under 21 years of age – Class C Misdemeanor

  • $500 – $2,000* fine
  • Up to 180 days in jail
  • Suspended driver’s license for 60 days
  • 20-40 hours of community service
  • Mandatory attendance to Alcohol Awareness meetings
